(Aaron Swartz beat prosecutors by increasing political support for open access. - Slate Magazine) ...it is both ironic and apt that Swartz’s defenders argue that the government should be prosecuting greedy Wall Street fat cats responsible for the financial crisis rather than ideologically overzealous hackers like Swartz. Ironic because the same populist outrage against dimly understood behavior motivates the call for prosecutions of hackers and the call for prosecution of bankers. Apt because the argument shows how much prosecutorial discretion both influences social policy and is in turn subject to political pressure.
As Orin Kerr has pointed out, this is a generic complaint about our criminal justice system. Lawmakers pass extremely broad and vaguely worded statutes that criminalize vast swaths of behavior then leave it to prosecutors to decide who to target and who to spare. The major constraint on prosecutors is limited resources, so they threaten defendants with draconian punishments to coerce them into plea bargains. Judges and juries remain backstops against the worst injustices, but because trials themselves are ruinously expensive and can end in long prison terms, defendants often forgo the protections they offer.

(IBD) The Left: An Occupy organizer admitted over the weekend that the goal of his protest group was to "overthrow the capitalist system and build communism." So the cat's out of the bag again on this bunch. Where is the outrage?
The true agenda of the Occupy movement has been revealed — it's a totalitarian one. Billing itself as a spontaneous people's revolution and embraced by the media and Democrat political establishment, Occupy is really a destructive band of thugs whose goal is the violent demise of democracy.
Speaking at a "People's Assembly" in Washington, former Amalgamated Transit Union local 689 president Mike Golash told Occupy members his goal was to "make revolution in the United States, overthrow the capitalist system and build communism."
The Occupy organizer added that he was "trying to learn something from the examples of the Soviet Union, Red China and Castro's Cuba. ... What can we learn from them so we can build a more successful movement to transform capitalist society?" he asked.
This attachment to the miserable failure of communism — an ideology that left 100 million people dead in the 20th century and met its demise as an idea after millions rose up in 1989-90 to repudiate it — is insane.
Remarks like Golash's were common among the Occupy mobs who filthied up Los Angeles and other cities last year — perfectly representative of Occupy thinking.
Such talk never fazed anyone at the "People's Assembly" either. Maybe that's because it's of a piece with the thinking of Occupy master planner, SEIU boss Stephen Lerner, who in 2011 said he wanted to bring down the stock market and destroy banks such as JPMorgan.
Occupy flourishes because it draws support and legitimacy from the media and like-minded Democratic politicians who pitch a fit anytime someone accuses them of supporting the destruction of democracy.
Not long ago, Democrats pounded Rep. Allen West for pointing out that Congress is loaded with soft-core communists who sugarcoat themselves as the "progressive caucus." They are Occupy's loudest supporters.
Democratic leaders such as then-House Speaker Nancy Pelosi hailed Occupy as "spontaneous," while President Obama himself heaped sympathy on the group, even intervening in a local police matter to keep Occupy Portland members from being arrested.
It's a disgrace. Occupy is nothing but a far-left group, learning nothing from the past yet drawing support from the left. Is communism the agenda they really stand for? From Golash's remarks, it looks like it.

(Pat Dollard)...Excerpted from The Washington Free Beacon: Numerous protesters at yesterday’s Occupy Wall Street rally in New York City viciously blasted President Obama as a horrible failure, signaling a major break from a liberal base that once celebrated Obama’s lofty rhetoric of hope and change.
“I feel that Obama, especially on the civil liberties perspective, has raped me in the a–,” admitted a shirtless man who donned a purple flower in his hair. “I’m not very happy with his job in the slightest.”
The disillusioned demonstrator, who identified himself as a financial analyst, went on to scold Obama for capitulating to Wall Street bankers and global monetary interests.
“The guy freaks me out a little bit,” the man said. “I’m not going to lie. He’s pretty, and we all think we did something because of his color, and I don’t discount that, but for f—k’s sake, he scares the hell out of me.”The growing dissatisfaction among the president’s most liberal supporters could make November’s election more competitive, as former Obama diehards stay home instead of casting a ballot in his favor.

Image via The Blaze Via Morgan Richmond at Hot Air:  (moon bat track) I’m not sure why, but I was expecting the occupy movement to re-group over the winter and get a little smarter about the types of tactics they are using. At times throughout our history civil disobedience has been used to advance causes which most of us would probably agree were for the betterment of the nation. I’m glad Rosa Parks refused to sit in the back of the bus and it sickens me that she ever had to. But fighting to end racial discrimination and demanding free stuff from a government going deeper and deeper into debt are not exactly morally equivalent, to say the least. And this fact isn’t lost on most Americans, regardless of whether the media continues to gloss over the occupy movement’s most egregious behavior.
Transport Workers Union Local 100 and the Amalgamated Transit Union apparently helped #OWS open up subway exits at about 20 subway stations across the city. They made official looking signs telling people to enter through the gates. The union goons who helped out with the stunt did it because they’re in contract negotiations with the MTA -- (which should certainly help with negotiations.)
The Fox 5 News crew was on the scene interviewing subway customers, most of whom were not amused by the juvenile hijinks.

The lecture was billed as "Occupy Wall St., not Palestine," and Barghouti made the case that it makes "perfect sense to think of Israel as part of the global one-percent in War Inc." He touched on the relationship between U.S. and Israeli weapons manufactures, suggesting that Israel's behavior as a "garrison state" enables more customers for U.S. produced weapons.

According to Twitter accounts by pro-Palestinian activists pushing the proposal, the statement won nearly unanimous backing in a vote Wednesday following a brief discussion. A lengthy statement on the Occupy Oakland website attacked US aid to Israel and suggested that Israel had "prodded" the United States into the wars in Afghanistan and Iraq.
The Oakland branch of the Occupy movement, which focuses on what it sees as economic discrepancies in the United States, has become increasingly visible for its refusal to repudiate violent action and clashes with the police. Last month, members of the movement broke into the Oakland City Hall and set fire to public property, including an American flag. According to the San Francisco Chronicle, the branch's actions have caused a schism within the movement.

Friends and relatives said Susan Poff and Robert Kamin of Oakland were the perfect pair to adopt a foster child.
They had dedicated their careers to helping others escape poverty, she as a physician assistant in a city-run clinic in the Tenderloin and he as a clinical psychologist for inmates in the San Francisco County Jail system.
But now, less than a decade after they adopted, their 15-year-old son stands accused of strangling both Poff, 50, and Kamin, 55, then hiding their bodies in the back of the family’s PT Cruiser.
Police were called to the family’s home on Athol Avenue on Friday by a co-worker who was concerned when Kamin did not show up for work.
According to an Oakland police source familiar with the case, the co-worker first called the son, who said his parents were out for a walk. Police arrived at the home Friday, spoke with the son, and didn’t find anything unusual. When the co-worker called the boy a second time later in the day, the son said he was in the bathroom and couldn’t pass the phone to his parents. Suspicious, the co-worker called police again.
Officers returned that night and noticed charring on the car, parked in front of the house, as if someone had tried to set fire to it. Then they looked inside the automobile.
Initially the son, whose name is being withheld because of his age, denied any involvement, but later told officers what had happened, authorities said. He was arrested on suspicion of murder Saturday and is being held at the Alameda County Juvenile Justice Center in San Leandro.
Co-workers said Poff and Kamin were having some arguments with their son, some of it having to do with him spending too much time in the Occupy Oakland encampment, but nothing that sounded beyond the scope of typical teenage rebelliousness.
“I never heard her express any fear about her kid, ever,” said Joshua Bamberger, medical director of the San Francisco Department of Public Health’s Housing and Urban Health Clinic, where Poff worked.
Sadly, a lot of these “Occupy” kids are going to need de-programming and years of mental and substance abuse counseling.
Great job, Democrats. Now two innocent people are dead just so you can gin up your base of support.

The ruckus caused by the protesters occurred after Santorum made remarks to supporters following his third place finish in the South Carolina primary on Saturday night. One female protester threw glitter on him before quickly being escorted away.
The protesters yelled phrases suggesting they disagree with Santorum’s stance on gay issues.
Another protester yelled “bigot!” as he was escorted out of the auditorium at the College of Charleston along with at least five other young people.

(WT) People monitoring the Occupy D.C. movement tell Inside the Ring that the two encampments are fast becoming health hazards. Numerous protesters also recently were sickened with unusual respiratory illnesses.
The major emerging problem for the leftists camped out in tents at McPherson Square and Freedom Plaza is rats. The rodents appear to be moving into the area by the hundreds, and their numbers are increasing daily.
The McPherson camp appears be where more radical leftists are based. An observer familiar with the McPherson camp said one distinctive smell coming from the park area is that of methamphetamine being smoked.
Among the flags being flown by some protesters are those from the Palestinian terrorist group Hamas, the Iranian-backed Hezbollah and al Qaeda.

nytimeslogo.jpg(mrc.org) New York Times art critic Holland Cotter’s year in review piece on Sunday opened with an awkward metaphorical shout-out to the lefty park-squatters of Occupy Wall Street and an excoriation of the “noxious” 1 percent: “Complacency Butts Up Against Game Changers.”
There was a lot of painting on view in Zuccotti Park this fall, in the form of Occupy Wall Street protest posters, free for the taking. And there was a lot of painting on the walls of New York art galleries, most of it post-M.F.A. eye candy with hefty price tags. The physical distance between Lower Manhattan and the Chelsea art zone is short, but the mental and moral gap felt immeasurable. The park was about light-on-its-feet, change-the-game politics. Chelsea -- leaden and inbred -- was about cash and caution.
True, art-worldlings did at least adopt one thing from the Occupy Wall Street movement: a new identifying label for the source of particularly noxious vibes emanating from art fairs, V.I.P. galas and museum boardrooms: namely the 1 percent. But why, you’ll ask, dis the ultrarich? Haven’t they historically been the primary bankrollers of great art?

Sure, except we’re not getting great art. By and large we’re getting high-polish mediocrity. You had really, truly, desperately need to believe in the perpetual wondrous newness value of contemporary work to conclude that the New York gallery season just past was anything more than a long flat line, with month after month of young artists rehashing yesteryear’s trends and veterans cannibalizing their own careers.

On July 22 Cotter revealed his suspicions of free-market capitalism in his review of an exhibit of Soviet and post-Soviet art: “Free-market capitalism brought its suppressions and exclusions, as artists discovered. Among other things, some felt, it undermined the purpose and value of art.”
I would agree... large public works are done best by totalitarian structures... and this is what is considered to be art. These same totalitarian structures have such contempt for Hollywood or Theme Parks, but that is where capitalism's expression comes from and if you step away from the academic egos you might realize that the majority of great 20th century culture (THE CINEMA YOU ART FAG! ...and maybe COMIC BOOKS) comes from Capitalism and not movements of large populations dedicated to a structure like a Pyramid or Murals on Ghetto walls.

From LA Times:Most of the roughly 300 Occupy L.A. protesters were released from jail by Friday evening, with some immediately speaking out on the police raid that cleared their camp. One speaker suggested that some of those arrested might need therapy. Several said they felt traumatized after witnessing police use nonlethal force and being forced to wait for hours in zip-tie handcuffs. Some displayed cuts on their wrists from the handcuffs. Others complained that they were forced to urinate in bags on the bus as they were transported to jails.
Therapy? They needed a Fucking job.... fuck it... I need a damn job. I'm tired of telling jokes about people who have a lot of time on their hands because there are no jobs and their ideas don't make jobs... meanwhile I'm sitting at home unemployed and making fun of these goons... and I don't have a fucking job either. For fucks sake... get me off the internet already before I piss off some liberal on the West coast and the state of Washington extradites me all over again. Can we please have some leadership already? Didn't we borrow like... I don't know how much... and you still can't give us something to do yet?

(FROM THE SULTAN) Using leftist occupations of public spaces in major cities as the kickoff to a campaign. How many people saw that coming and how many expected it to work? But it worked well enough to engage the younger voters who helped boost him last time around. And it's not the end of the show.
It's tempting to see Obama as another Carter or Dukakis, a malaise ridden liberal, but while he has a good deal in common philosophically with them, his image and his campaign have little in common with theirs. And it's also worth remembering that Reagan's defeat of Carter was not nearly as easy as some would make it out to be.
Reagan's victory might not have been nearly so decisive without the involvement of an independent candidate who drew votes from Carter. And even that victory was not always inevitable. Before the debate, Reagan was polling behind Carter. Had Carter avoided debating Reagan and avoided challenges from the left, it's not inconceivable that he might have pulled off a second term. (YES HE CAN?)

"I was standing in the middle of the crowd when the police started moving in," she says. "I was screaming, 'I am pregnant, I am pregnant. Let me through. I am trying to get out.'"
At that point, a Seattle police officer lifted his foot and it hit her in the stomach, and another officer pushed his bicycle into the crowd, again hitting Fox in the stomach. "Right before I turned, both cops lifted their pepper spray and sprayed me. My eyes puffed up and my eyes swelled shut," she says.
She was fine for a couple days, until she started feeling sick.
Jennifer went to the doctor and found out her baby had no heartbeat. "They said the damage was from the kick and that the pepper spray got to it [the fetus], too."

(thegatewaypundit.com) Jennifer Fox has a habit of exaggerating and Seattle police are investigating the incident. Jennifer never even told her family she was pregnant like she claimed in an earlier report.

Seattle police have launched an internal investigation after a 19-year-old woman says she suffered a miscarriage after being pepper sprayed at an Occupy Seattle protest.
Jennifer M. Fox says police kicked her and hit her in the stomach with a bicycle Nov. 15 and also doused her with pepper spray. She says she was three months pregnant.
The Seattle Times says Fox has declined to provide medical records supporting her claim that she had a miscarriage five days after being hit.
Seattle police spokesman Mark Jamieson says the department is looking into the situation because of the seriousness of the allegations.
The Times reports that Fox’s family doubts her story.
Her former foster mother, Lark Stebbins, says Fox has a history of exaggerating and never mentioned she was pregnant when they spoke recently.

On November 18th, 2011, Muslims held a rally in New York City. The point of the rally was supposedly to protest the NYPD’s surveillance of the Muslim community. As the rally progressed, however, Muslim leaders acknowledged that they share the goals of the Occupy Wall Street Movement, especially seizing and redistributing wealth. Indeed, Muslims claimed that the redistribution of wealth is commanded by Allah.

David Wood of Answering Musims was at the New York Muslim protest against counter-terrorism measures. Wood adds, “Muslim leaders claimed that the Occupiers were doing the work of Allah, and that Allah commands Muslims to seize and redistribute wealth. They also linked the ‘Arab Spring’ with the ‘Occupy’ movement. If Muslims are claiming it, I’m not sure how the media can keep denying it.”

Note the (minute 2:27) outrage solidarity expressed for their “colleague” Imam Luqman Ameen Abdullah, who died in a gun battle with federal agents, yes, a gun fight, when the devout imam refused to surrrender to authorities to face various criminal charges.
Abdullah is the spiritual leader of a group that is alleged to have engaged in violent activity over a period of many years, and known to be armed. According to the report obtained by the National Association of Chiefs of Police, the FBI was in the midst of arresting Abdullah and 10 of his followers on charges that included conspiracy to sell stolen goods and illegal possession and sale of firearms.
According to a preliminary report obtained by NACOP, Abdullah was killed while exchanging gunfire with Federal Bureau of Investigation agents on Wednesday at a warehouse in Dearborn, a suburb of Detroit.
Abdullah was the leader of part of an group of Islamists who call themselves Ummah (“the brotherhood”), a group of mostly African-American converts to Islam, which seeks to establish a separate Sharia-law governed state within the United States. (here)
The Ummah is ruled by Jamil Abdullah Al-Amin, formerly known as H. Rap Brown, a 1960s radical and Black Panther.
