It is one thing for a grieving father to defend his child. It is another thing for a news outlet like RT to shamefully report this.

(Our Legal System Didn't Give Aaron Swartz a Chance) In his book Three Felonies a Day, veteran defense attorney Harvey Silverglate warns that "the trend of ambitious prosecutors exploiting vague federal laws and pursuing criminal charges instead of more appropriate civil actions" makes potential criminals of us all.  Redundant indictments for multiple offenses flowing from a single act -- and threats of lengthy, life-destroying sentences -- enable prosecutors to extort pleas from innocent or not-terribly-guilty defendants. It is often "nearly impossible for normal, rational, self-interested, calculating people to risk going to trial," Silverglate observes. Moreover, the minority of people willing to take that risk may be deprived of the means to do so by pretrial orders freezing any assets allegedly generated by their alleged offenses.

This weekend the internet mourned the loss of one of its folk heroes. Aaron Swartz, a co-creator of RSS and an early employee of popular link-sharing site Reddit, was found dead in his New York apartment on Friday. The post-Reddit era in Aaron's life was really his coming of age. His stunts were breathtaking. At one point, he singlehandedly liberated 20 percent of US law. PACER, the system that gives Americans access to their own (public domain) case-law, charged a fee for each such access. After activists built RECAP (which allowed its users to put any caselaw they paid for into a free/public repository), Aaron spent a small fortune fetching a titanic amount of data and putting it into the public domain. The feds hated this. They smeared him, the FBI investigated him, and for a while, it looked like he'd be on the pointy end of some bad legal stuff, but he escaped it all, and emerged triumphant.
He also founded a group called DemandProgress, which used his technological savvy, money and passion to leverage victories in huge public policy fights. DemandProgress's work was one of the decisive factors in last year's victory over SOPA/PIPA, and that was only the start of his ambition.

Do a google search for 'Noah David Simon' and you can see they did to me what they did to Aaron Swartz. The difference with me is I could see my opposition. This guy was too far on the inside to realize that he was in the lion's den. His crowd was with people who distributed a lot of Palestine propaganda... against free markets. Though Abbas leader of Fatah appears to claim to be Libertarian, Fatah started as a Socialist movement. You can realize that copyright is obsolete without railing against private property. Free markets recognize there are somethings you can not own. It doesn't mean the government owns it. I'm sure Aaron's friends feel they are closer to Libertarians, like Abu Mazen... but that just becomes sustaining an unsustainable system. It's a lie either way. Socialist or Libertarian... it's breaking the rules. Anarchy always defaults to tyranny.

If he had been found guilty of the charges, Swartz faced up to 35 years in prison and millions of dollars in fines, although it has emerged that negotiations between his lawyers and prosecutors had included a potential plea bargain of six months in prison. Condemnation of prosecutors over the litigation against Swartz continued on Tuesday. A petition to the Obama administration to remove Ortiz from office reached 28,188 signatures, past the crucial 25,000 signatures needed for a White House response. In July 2011, Ortiz said in a statement about the case: "Stealing is stealing whether you use a computer command or a crowbar, and whether you take documents, data or dollars. It is equally harmful to the victim whether you sell what you have stolen or give it away." Lawyers for Swartz said that, despite their best efforts, prosecutors had refused to negotiate a plea bargain which did not involve jail time. One also said that MIT refused to agree to a plea bargain in which Swartz did not serve time. Andy Good, Swartz's initial lawyer, told the Boston Globe that he had warned one prosecutor, Steve Heymann, that his client was a "suicide risk". Good said: "His reaction was a standard reaction in that office, not unique to Steve. He said: "Fine, we'll lock him up." I'm not saying they made Aaron kill himself. Aaron might have done this anyway. I'm saying they were aware of the risk, and they were heedless." Lawyers for Swartz said they had offered to accept a deferred prosecution or probation, so that if he did it again he would serve time. Marty Weinberg, who took the case over from Good, told the paper he nearly negotiated a plea bargain in which Swartz would not serve any time. He said JSTOR signed off on it, but MIT would not. "There were subsets of the MIT community who were profoundly in support of Aaron," but that support did not override institutional interests, Weinberg told the Globe. Another of Swartz's attorneys, Elliot Peters, said on Monday that MIT officials were "very cooperative with prosecutors" during the investigation. "MIT could have handled things differently, rather than inviting law enforcement and turning it into a federal criminal case," Peters said.

But Aaron did not fake his suicide. He must of been disappointed by the third movie.

An Israeli project, which is set to boost the museum's security, will further entail the installation of Synel's time and attendance management hardware, as well as the use of fingerprint verification, keypad entry, magnetic card, barcode card, proximity card, contactless smart card and facial recognition. According to Erez Buganim, Synel's Vice President of marketing, the Louvre is continuously exposed to burglary attempts, even by employees. "Therefore, the security system is needed. It will prevent unauthorized personnel from entering areas in the museum where priceless art is held in," he said. "There are art pieces that aren’t always on display for the public and even the museum's employees can't reach certain exhibition spaces at all times," he said. "Synel offers a technological solution which will monitor unauthorized entries into the museum and within the museum's exhibition spaces," Buganim added. The Israeli technology will allow for the museum's security team to track the Louvre's 700 employees. Synel France and England CEO Danny Farber expects that by the end of 2012, over 200 French organizations will be using the new technology. "The project at the Louvre is one of several new projects, Synel has recently started in France and England."

I'm skeptical that the French public won't freak out when they realize that the system used in a museum could also be used by street cameras and could track terrorists. They of course will point out that it is an Israeli technology that is obviously using art as a sidetrack. No doubt this would create the ultimate Panopticon. Already most cities have cameras installed all over the place. With facial recognition technology it'd be impossible to hide from the government. It is an interesting technology however. The same article had a link to another Israeli facial recognition company that facebook just bought. That is quite frightening to think in the future you will have to go in front of a camera and have Artificial Intel judge to see if you are you.

The_American_Revolution had been partly caused by the economic problems of two monarchies, England and France, the former of which began squeezing the Colonies in order to balance its own books, and the latter which bankrupted itself by backing the revolution. The British monarchy became a shell after centuries of internal conflicts caused in part by its constant need for new sources of revenue. The French Revolution was in turn caused more by a demand for financial accountability from a free spending monarchy, than by the grand ideas like Liberte, Egalite and Fraternite. Meanwhile America's own earliest conflicts between individual rights and the Federal government, such as the Whiskey Rebellion, were caused by the government's need for revenue.

With a massive rising national debt that threatens to consume the entire productive capacity of the United States, modern day America is going down the very same road as the Kings of France. And the process has been radically accelerated by the transformation of the role of government, from that of the "fence" around our rights, to the "provider" of rights, and beyond that government had also redefined rights as services. And just as it costs more to put a nanny in every home, than to hire a watchman for a single block, providing services takes government to a whole new spending level.

How the Internet Destroyed American Politics

Politicians have realized that by lowering the barriers to political involvement they can attract people who otherwise wouldn't care. And so we have an entire class of people who are involved in politics because they think Obama's posters look cool or because they're angry that Sarah Palin's daughter almost won Dancing with the Stars. Call them the Alvin Greene vote. They don't understand a single issue, not even the dimmest populist ones, but they are emotionally involved with the image that the candidates project. They vote based on Saturday Night Live skits or what they hear on The View. Often young and dumb, for politicians they're an important target group. And they make up an increasingly large share of media consumers.

the internet has eroded the firewall between the American political process and the rest of the world. The damage that Soros and Assange have been able to do to America should be a wake-up call in that regard.

A lot of the world feels it should have a say in American elections, and 2008 was the first time they got a say. It will probably not be the last.

We don't know how much foreign money Obama received in 2008, but it's safe to say that this will continue to be a problem, and without rigid legal accountability, this will become a pattern in future elections. With every candidate soliciting online donations, it becomes all too easy for money to trickle in from abroad. Accountability may close that door part of the way, but not all the way, because too many 501c's also have an impact on the political process. As do many groups that are not directly involved in elections, but do play a part and can legally receive money from overseas. It will take hard work to insulate the American political process from foreign donations. And with the rise of foreign exchange trading and online gambling interests based overseas who work through American front companies, that may no longer be possible.

And foreign money is the least of the problem. With social media playing such a major role, foreign campaigners will become ubiquitous. The Obama campaign benefited from a social media network that was often very "international". In the age of the internet, it becomes all too easy to run phone banks out of Gaza, raise money in Moscow and have stories that shake up the campaign appear in The Guardian. When enough of the campaign is being outsourced, it becomes impossible to regulate or track who does or says what on the internet. And that means anti-American candidates for public office now have a base of support that they can rely on. It worked for Obama. But it won't end there.

The only thing that could avert this would be if such conduct were viewed as scandalous, but the media is unlikely to treat the outsourcing of a campaign as scandalous, unless it's done by a candidate they don't like. Which means punishing a politician for his politics, rather than his actions, another reminder of why the media cannot be trusted to vet candidates or do anything but act as cheerleaders for their man or woman.

The internet is international and it is internationalizing American elections. We are now told which candidate has international approval. We have campaign rallies overseas. We have money coming in from abroad and unofficial campaign volunteers operating abroad. And that is only be the beginning.

Technology has erased distance, and that means the end of all forms of isolation, privacy and integrity. It has also erased standards and barriers. It is up to us to try and create new standards in the age of the internet. If we fail to do this, then the medium will go on dictating the message.

BatMan Panopticons?

the philosophical and political issues were played well. Dark Knight is most certainly an argument for voting Republican. Surveillance to fight violence? The need to lie to save Democracy and Justice? I don't think Obama would feel comfortable dealing with the Joker. The line between murder and torture were delineated between Two Face and Batman. BatMan is a Republican who understands the Black Hat that justice sometimes has to take.... he tortures, but never takes a life. We need to get BatMan a job at Guatanomo. BatMan McCain for president!


The entire movie evolves from a delineation between "Two Face", "BatMan" and "The Joker". "Two Face" even in his human pre-identity never has the moral backbone that "BatMan" has (that is a given from the comic book). Harvey Dent tortures and is not afraid to kill. He makes that very clear and takes on the character of "Two Face" before he becomes "Two Face". BatMan corrects this action, but has no problem torturing the "Joker" when he is in jail. Therefor we can assume that "BatMan is not beyond torture, but will not take the death penalty into his own hands. One can assume that BatMan would understand Guantanamo... but would never kill because he is not due process. A government sanctioned war is part of due process. As for the Joker... he remains the terrorist... or even a "Super" Terrorist in that he would kill... even if he does not benefit. Remember Joker is not about the money and personal benefit. He BURNS the money. Joker wants to terrorize for the sake of terror because he is angry. He has no meaning at all. The Joker has no structure he believes in. One might even argue that the joker doesn't even care about his own life and takes destroying the establishment to be his first priority, He has Harvey Dent put his gun to his head to see if he can prove that Dent in no better then him. He laughs at BatMan to encourage him to break his own values and kill him.

statistics are dangerous and misrepresent, but a terrorist attack has greater ills then the loss of human life. It is a symbolic act that can create chaos and destroy strong bonds. you fail to understand the power of terrorism if you think of terrorism as simply the loss of human life. Example Hezballah and Lebanon lost more life against Israel, but that was not the determining factor of righteousness. Israel was defending itself. Germany lost millions during WWII, unfortunately life is not always the determining factor of who is right and who is wrong. by breaking the rules we become terrorists. Rule breaking isn't necessarily morally wrong. Panopticons broke understood precedent on twitter (but not twitter terms). No one died. I consider it a guerrilla act against the twitter A List establishment. It was a success in creating a sense of distrust in the twitter community. No one died. Am I wrong?

I just want to remind twitter that Panopticons was created not to be a nuisance, but rather to remind the community that the transparent architecture of twitter with obvious security pratfalls is no place to solicit for the support, councilors and so called "advice givers" for military. EMail our Military claims to screen applicants, but I found them soliciting council in the most hostile on neighborhoods on twitter. Besides the fact that most of the population online is very against the war like Reverend Wright and sympathetic to terrorist action, I'm also concerned as to the mental health of soldiers in the military dealing with such complexities when mere day to day survival are of issue. It is a great irony that twitter deleted Panopticons for architectural in-fractures! Panopticons exposed twitter for hypocrisy and the only reason it was disabled was to censure, which is what twitter should of been doing from the get go with Email our Military.The American prison systems of the late 18th and 19th centuries utilised the notion of the Panopticon - Jeremy Bentham's design that allowed all prisoners to see each other (pan, all; optic, see/observe) and therefore reduce the duty and necessity of prison guards.The original panopticon got the prisoners to work menial jobs whilst all in each other's sight lines, therefore turning the watched and the watchers into one.

The modern twitter Panopticon of pure transparency has been exposed. The twitter transparency is only transparent when @Jack wants it to be, and it is very obvious that twitter wants the safety of American youth serving in Iraq to be transparent. There is no doubt that twitter is very hostile to male culture, what better way to surveillance what twitter fears more then anything else? Of course twitter is attempting to hide behind transparency. Of course twitter will claim there in no censorship! That is what a Panopticons is all about. Even facebook has some opaque elements, but twitter is just pure tyranny because what is opaque is arbitrary and dependent on pretensions.

Cyberbullies and hackers targeting sucessful women?
...there is a certain matter of Get Satisfaction's right to allow people arbitrarily accuse me of stalking. I'd like to make the case for libel if Get Satisfaction and TWITTER want to be so random. I want to give an example of "stalking" that is going through the courts in Beverly Hills (where MySpace is based) and let me establish and elaborate why what I am doing is different. If anything what people are doing to me is close to the "cyber bully" of Missouri.

differences are the following
(1) it is very clear that all my accounts were in fact me. Everything I did was transparent, as opposed to the actions of TWITTER that took action without informing me.

(2) I never pretended that the accounts were not me.

(3) I never got intimately involved in such a way with any of the above people that I could inflict emotional pain after impersonating another person. frankly it would be a very sad thing if the woman defendant in this case above "IS" convicted. This would open the floodgates for all kinds of accusations that would put innocent people in jail.

(4) (a) if there were architectural breaches and not vile content issues, then the breaches of twitter architecture were not clearly outlined. (b) if the issue is vile speech then why did twitter let me get harangued by Palestinian sympathizers that were clearly anti-Semitic like @MarkDavidson and @QueenofSpain? Certainly @Hamas should be censored then as well.

(also what was with @MarkDavidson's JewFro joke? someone explain it to me because I didn't get it.) BTW Here is a little of what I went through with Mark Davidson <--click here One of the worst things about having your account erased is that all evidense is taken out of the forum.It is a good thing I have reserved much of it, but admitedly my evidence against @QueenOfSpain is on my old accounts, that twitter conveniently erased because they don't care about harassment at all. But this we all know.

(6) if the RSS feeds go to an imaginary friend in friendfeed, is this still stalking? Why are my actions an infraction of the architecture and not an infraction of content?

  I'm not an absolutist. I don't believe in a pure open society and I don't think it would be wise to make one. 

The reason my system exists is to show@mailourmilitary how easy it is to create an account on twitter and cycle information somewhere. It was an argument aimed at this group of people who were using group cyber-bully techniques to silence any who spoke out against@mailourmilitary. I couldn't see any other way to defeat a group of people who tried to bombard they're opinions into truth by getting military personnel to write me and tell me how much they liked hearing from TWITTER people in Iraq. I felt for the soldiers, but this was just a ruse for a few lonely ladies to feel good about themselves and did not take the needs of the military into high regard.

next panopticons will be an imaginary friend in friendfeed that uses rss from sneak accounts on twitter. how does that break architecture on twitter? ur thoughts? and will twitter bother to delete the accounts now? the reflection will happen off twitter!

as the panopticons fellow... imagine instead of 21 twitter accounts. 21 friendfeed accounts and you don't tell people they are all you. you then have a conversation with yourself and force yourself to the top of the feed. yes I have already thought about it

Your company has led many to believe that you are not censoring. this implies some kind of inherent science to you're methods. Censorship is your right as a part of private property. Your social network is your property, but you set a precedent for people to leave. They will, especially with all the downtime your company has had as of late. You are delusional if you think you are above some censorial duty. (The argument that you are a monopolizing government that should not censor except in threatening cases is valid, but I will not use this here for a sake of argument because the accusation of a monopoly has not been proven yet.) I expect you to censor. I also expect there to be a backlash against you if you do without reasonable doubt of physical harm. you claim I have broken the architecture, but if so then you have to disable @chrisbrogan 's account because he is the one who theorized of the possibility of "panopticons". Another slippery slope. Certainly your architecture needs to be open enough with freedoms so that people can practice free will, but if this is so then twitter needs to stop being a coward and elaborate on what architecture abuse is. (and before you delete the accounts... not afterwords! shame on you!) At a certain point you are passing judgment with discretion. just now on this page I used foul inappropriate language, but I used it in the context of the forum here. There is no consistent method to this. The fact that you think there is, is a huge problem! Yes you can delete my accounts... but this is not the end of this. The pandora box has opened and if you do not elaborate and detail exact situations of abuse then the only people who are guilty of breaking your architecture is yourselves. Tell your buddies at twitter and co. that I am making my next campaign an education on how to build another "panopticons". Now there will not be one, but rather many. Your error will now be viral. Next time do your company a favor and include the alleged in your thought process. In courts both parties have to keep each other informed of what information is at hand. (witnesses, evidence, etc.) It is hard to take a company seriously about they're pretensions of free speech without the transparency. you're no better then any other social network. you seem to think your farts smell better. We all do.

I'm impressed that I caused such lengthy dialogue.
I'm not going to deny that I'm going to savor this moment of seeing my name in a thread... but frankly I'm bored with this and most of the threaded issues related to @panopticons. feeling a lot of butting heads. I'm a creative person and I feel that this social culture is way too transparent for free thought to really emerge... but this is all theory. I sincerely doubt I ruined your day as much as you say I have. Get a LIFE!

first let me deal with the personal
I'm not crazy.
My actions were premeditated and thought out for a very long time.
If I am crazy... that is a very slippery slope.
I don't think anyone here is crazy. I think some of you have an agenda, but that is not crazy. I see you benefitting from the context I am presenting you.

(1) Kosso. No Apologies to you. Your worse half is not a nice person. She was hostile from the get go. Don't expect me to act like a gentleman online. I am not a physical threat to her. She is the one that instigated the nastiness from the very beginning. The worst thing is she assumed this was all about her, when @panopticons had nothing to do with her personally. That is how vain she is. Frankly she's just a curmudgeon, but kind of a stupid one.

(2) Queen of Spain is a NAZI... and so is anyone who has Reverend Wright's opinions. As a Jew I'm not afraid to use the term NAZI just because you feel uncomfortable with it. Stalin was a NAZI, Arafat was a NAZI and so is Queen of Spain. I'm not going to get penned in by how you define your language. For me NAZI is a person who hates JEWS. Either directly or indirectly. I will defend myself physically and those that go out of they're way to mess with Jews I will take action. Kind of pointless to talk about theory when you have a gun to your head metaphorically. I have no delusions or grandiose pretensions of pacifism.

(3) Roy Blumenthal your exactly why I created Panopticons, because "Leftists" like you always see censorship and power as a convenience for your own ideas. Your more in love with the label of liberalism in your own head then the people who get hurt by your orthodoxy. Your not about liberties. There is nothing "Liberal" about you.

(4) you don't like it. block it. I didn't create the twitter architecture and frankly I'm as frustrated as everyone else with it's drawbacks. I'm exploring the boundaries and we all should.

(5) please don't bring my family into this. For one thing if your real issue is my politics then you should know that I am the only conservative in my family (probably ever). My father was a well known war protester. Both of my parents come from the Ivy League Elitist establishments that I have fought with my entire life. I have to deal with differences in opinion in my own family everyday.

Prokofy, I'm sorry you had to deal with all the bad apples that have been driving me up a wall this year. My advice is stop. There is no dialogue with these people. They have a different agenda which is not the open minded element of your own. I am sorry for putting you into this. Nothing has been gained by your dialog or diplomacy.

yes. this is what I want. I want people to realize how narrow minded they're little categories are. Prokofy... you made it all worth it. You can't stop my voice and you can't stop a retweet... twitter can disable accounts, but I can build a new panopticons every day. My next step though will not be to create another panopticons, my next step is to encourage and teach others to build they're own. You might not realize it, but I'm doing you a favor. Every high school kid in America will so be doing exactly what I am doing. I know I didn't innovate this idea. I heard Chris Brogan talking about the flaw months ago. The idea of panopticons is to publicize the flaw. you better stop attacking me personally, because every kid who gets blocked by a PMS infused retrobate like Kosso's girl will be building they're own @Panopticons very shortly
