Iowa court: Employers can fire workers they find too sexy

Good! People make judgments about what is good in their workplace. Sexual distractions are a factor and society doesn't work otherwise.

The Iowa Supreme Court ruled on Friday that employers in the state can legally fire workers they find too attractive. In a unanimous decision, the court held that a dentist did not violate the state's civil rights act when he terminated a female dental assistant whom his wife considered a threat to their marriage.
The dental assistant, Melissa Nelson, who worked for dentist James Knight for more than 10 years and had never flirted with him, according to the testimony of both parties, sued, saying she would not have been fired if she were a man.
At trial, Knight testified he had complained to Nelson on several occasions that her clothing was too tight, revealing and "distracting."
Knight argued that Nelson was terminated not because of her gender - all the employees of his practice are women - but because of the way their relationship had developed and the threat it posed to his marriage.
The seven justices, all men, said the basic question presented by the case was "whether an employee who has not engaged in flirtatious conduct may be lawfully terminated simply because the boss views the employee as an irresistible attraction."
The high court ruled that bosses can fire workers they find too attractive and that such actions do not amount to unlawful discrimination.

Sex scandal, 'Palestinian' style

'Moderate' 'Palestinian' President Mahmoud Abbas Abu Mazen has put the kaboshes on an investigation into a sex scandal involving one of his ministers until he returns from the United Nations General Assembly in New York (where he is due to speak on Thursday). The 'Palestinians' are already accusing 'people opposed to our statehood bid' of being behind the scandal, even though Abu Mazen has supposedly promised President Obama that he would not bring up the statehood bid until after the US elections on November 6.

Mahmoud al-Aloul, a member of the Fatah Central Committee, said the scandal was part of a scheme designed to foil Abbas’s renewed statehood bid.

Ghazali quoted Abbas as telling two senior PA officials who presented him with details of the sex scandal as saying: “Close the case until I return from the US because this is a sensitive time and we are facing elections. If the public learns about it, we will lose the presidential and municipal election. We already have enough scandals and don’t need more.”

The scandal erupted after a Palestinian woman complained that Hussein Sheikh, a top Fatah official who serves as PA Civilian Affairs Minister, harassed her sexually and tried to bribe her and her husband.

The woman, who works in Sheikh’s ministry, said the minister summoned her to his office on the pretext that he wanted her to help fix a computer.

Ghazali said that the woman, who is married and has two children, spat in the minister’s face after he tried to force himself on her while the two were alone in his office.

According to Ghazali, the minister later sent her a number of SMS messages to her mobile phone in which he continued to harass her sexually.

The woman’s husband, Ahmed Abu Alam, 30, also works in the ministry and is a former commander of Fatah’s armed wing, the Aksa Martyrs Brigades.

Upon hearing from his wife about Sheikh’s behavior, the furious husband stormed the minister’s office carrying a pistol, but did not find him, Ghazali said.

According to the investigative journalist, Sheikh later offered the husband $10,000 and a promise of promotion for him and his wife in return for their silence.

Abu Alam said he and his wife filed a complaint against Sheikh with various PA security forces in Ramallah and members of the Fatah Central Committee, but to no avail.

He added that he also provided the security forces and Fatah leaders with evidence implicating the minister, including the text messages and the cash.

The husband said that he and his wife have since been facing a campaign of threats and intimidation to force them to withdraw their complaint.

Last week, Abu Alam and his two brothers, Nasser and Muhammad, were detained for four hours by the PA’s Military Intelligence Force in Ramallah.

Upon his release, Abu Alam went to Abbas’s office and demanded to talk to the PA president. “I was told that he had traveled to the US,” the husband said.

As (Volokh) noted last year, a federal prosecutor indicted a man for his campaign of insulting Twitter messages about a Buddhist religious leader, and a federal judge then dismissed the indictment on First Amendment grounds.
Some of the Twitter posts might have been seen as threatening, but the government’s theory wasn’t that they were threatening, but that they where posted “with the intent to harass and cause substantial emotional distress to” the religious leader, and actual caused such distress, in violation of the federal antistalking statute, 18 U.S.C. § 2261A. The district court correctly held that the statute was unconstitutional as applied, and left open the possibility that it might be unconstitutional on its face as well. The government appealed, but earlier this month decided to drop the appeal.
Now the Senate, rather than tightening the law to prevent its being applied to constitutionally protected speech, is considering expanding it. Section 107 of the Violence Against Women Reauthorization Act of 2011 (which (Volokh) blogged about below, as to a different constitutionally troublesome provision) would take the existing statute and have it cover not just speech that causes substantial emotional distress, but also speech that “attempts to cause, or would be reasonably expected to cause substantial emotional distress,” so long as the speaker is intending to (among other things) “harass” the target. Anyone who

with the intent to … harass … uses the … any interactive computer service … to engage in a course of conduct that … causes, attempts to cause, or would be reasonably expected to cause substantial emotional distress to [the person or the person's family member]

would now be committing a federal crime. If the statute were just limited to conduct and speech intended to threaten someone — which the rest of the statute does cover — there would be no constitutional problem. But trying to outlaw speech that is made “with the intent to … harass” and “would be reasonably expected to cause substantial emotional distress” often violates the First Amendment, as the federal judge rightly held in the Twitter case. It seems to me that Congress should be fixing this constitutional problem rather than expanding it.

This is fascism. plain and simple. proving a person has intent to upset another person is no reason to take their free expression away. I have experience with this kind of legal abuse. (Reuters) - Democratic Oregon Congressman David Wu has been accused by a teenage girl of an unwanted sexual encounter, and has called the accusation "very serious."

Don't assume he had sex at all with the girl. She might just be paranoid of the wackadoo in the Tiger suit.

News reports said the young woman is the daughter of a campaign donor and high school friend of the seven-term Congressman.
The unnamed accuser is from Orange County, California and graduated from high school in 2010, the Oregonian newspaper reported.
"This is very serious, and I have absolutely no desire to bring unwanted publicity, attention, or stress to a young woman and her family," Wu, 56, said in a statement obtained by Reuters on Saturday.
Reuters contacted Wu's office, but his spokesman declined further comment.
David Swanson, an Irvine, California attorney and spokesman for the girl's family also declined to comment.
Wu is the first Chinese-American elected to the House of Representatives.
The Oregonian reported that Wu told his staff the alleged encounter with the teenager was consensual.
Several of his staff earlier this year listened to a distraught voice mail left by the young woman, accusing Wu of aggressive and unwanted sexual behavior, it said.
The newspaper did not name the young woman or its sources for the story.
Wu's behavior has in the past drawn criticism.
In February he announced that he was undergoing psychiatric treatment after his staff complained about his erratic behavior in the run up to the November 2010 Congressional elections.
They said Wu had behaved strangely at meetings and had e-mailed pictures of himself wearing a tiger suit to staff. Several key staff members resigned following the election.
In 2007 he gave a speech on the House floor comparing Bush administration officials to members of a fictional alien race on "Star Trek," saying "There are Klingons in the White House" sending "real Americans to war."

(AP) — Single mothers, former drug addicts and other struggling young women who came to wealthy businessman Henry Allen Fitzsimmons for a chance to climb out of their financial hole knew his help came with a catch. In exchange for an allowance, a place to live and promise of a college education, they agreed to be spanked if they broke his rules.
At least six of the women say his corporal punishment went too far, including one who says he sexually assaulted her, and the 54-year-old Virginia Beach restaurant owner faces felony charges.
"These women are victims. They're single moms. They need their bills paid," prosecutor Tom Murphy said at a court hearing Thursday. "It's bizarre, there's no doubt."
Fitzsimmons' attorney claims his slight, white-haired client is the victim, taken advantage of by women half his age who knew what they were getting into and filed charges only after a falling out.
"He's not a danger," Fitzsimmons' attorney, Moody "Sonny" Stallings Jr., told The Associated Press of his jailed client. "Strange, but he's not a danger to anybody."
A judge on Thursday allowed a grand jury to decide whether to indict Fitzsimmons on two felony abduction charges and three felony object sexual penetration charges filed against him. Six other assault and sexual battery charges were dropped because prosecutors acknowledged the women had agreed to the spankings.
For months, Fitzsimmons gave each of the women $200 weekly, promised to pay for their college tuition, treated them to lavish nights on the town and even bought one a car as part of his so-called Spencer Scholarship Plan. They were spanked if they violated rules, such as failing to call Fitzsimmons or drinking too much alcohol.
Several websites, including one run by Fitzsimmons, tout the Spencer plan and the scholarship program, which provides full tuition, room and board in addition to an allowance for participants as long as they follow the plan.
It is unclear how many women have participated in Fitzsimmons' program. The six who filed the criminal complaints had all been members, but Fitzsimmons' attorney said there have been several others.
The Spencer Plan started in the 1930s as a form of "carefully regulated corporal punishment" between husband and wife. Couples agreed to a list of things the wife needed to change, such as not spending money frivolously. If the rules were broken, the husband punished her by spanking and it was put behind them. It has expanded through the years.
One 21-year-old woman testified Thursday that the day she joined the program in November, Fitzsimmons spanked her and gave her $300. He paid for her to live in an oceanfront suite and gave her a $200 weekly allowance. In return, she was required to walk 20 blocks each day, keep a log of her meals and spending and refrain from drugs. When she didn't, she was spanked.
Fitzsimmons took it further, she said, when on three occasions he sexually assaulted her with a curtain rod, a hairbrush and a horse riding crop. When asked by attorneys why she allowed it to happen, she replied: "I'm not allowed to tell him no."
The Associated Press does not identify those who say they were sexually assaulted.
Another 22-year-old woman said she thought the program was an amazing opportunity. She had only been spanked once before she went to him in January to discuss him paying for her 3-year-old child's birthday party. She said he refused to let her leave until she let him spank her.
She and others said they feared Fitzsimmons, who walks with a limp. They say he made vague threats and convinced them they couldn't make it without him.
"He terrorized my life," one woman said. "He took me away from all my friends and family and convinced me nobody loved me but him."
None of the women filed charges until Fitzsimmons in April accused one of them of stealing money and fired her from his restaurant, the oceanside Envy Bar and Grill, where many of them worked. A week later, six women began filing charges. On Thursday, that former employee's complaint was dropped, along with those of two other women whose only complaints were that they had been spanked.
"Who's the victim here?" Stalling asked in court. "They were taking the money and all of a sudden when the mother gets fired they all run down to the police station and want to file charges."
Fitzsimmons came to Virginia Beach last year from Minnesota, but much of his past is a mystery. He has a master's in business administration, but his much of his attention is spent counseling young women and helping those in need, friends said.
Terry Schantz and his girlfriend are helping run Fitzsimmons' bar since he was arrested in April and denied bond. He said Fitzsimmons was a generous and caring man who would buy groceries for those in need or find the homeless a place to live. He said he can't imagine Fitzsimmons being violent.
Stallings admits the case is strange but says Fitzsimmons is no predator.
"They're trying to say he preys on these women," he said. "These aren't 15-years-olds. These are all adults and they're getting the money from this old guy."

Al Franken successfully introduced a bill to bar defense contracts from going to companies who behave likewise. Left wing media boasted that they were the defenders of rape victims, while Republicans support rape.

Now for the 50th anniversary of the Peace Corps, it's been revealed that over a 1,000 female volunteers have been raped in the last decade. Numbers that are positively 9/11 in scope. And that the idealistic Peace Corps leadership acted like the evil Haliburton leadership, blaming the victims and discouraging them from seeking legal action. There are no cries that Democrats support rape. No bills to defund the Corps, that awkward legacy of New Frontierism. This time it's Republicans like Ileana Ros-Lehtinen stepping up to demand accountability. And it's the Democrats who are standing in the way.
Similar parallel stories involve female activists who head to the Palestinian Authority to combat Zionism, and the assault on Lara Logan in the middle of what was billed as a democracy celebration. Each time the assault was minimized, until the woman in question decided to speak out.
It's an old story about the naivete of Western liberals who imagine that the Third World is somehow better than because it is less materialistic, finding themselves in cultures where the inequality of women is a given, meeting a man's eyes is considered a sexual invitation, and the only justice system that matters is kinship based. Crimes are acted on depending on family influence. And Westerners in Africa or the Middle East have no family there. Which means crimes against them can go unpunished if no pressure is applied.

Each time they stopped at a checkpoint, soldiers would punch them or hit them with rifle butts, according to the Times report.
The first night they spent in the back of the vehicle and for the second they were put in a dirty cell with a bottle to urinate in and a jug of water to drink.
On the third day, they were blindfolded and put on a plane to Tripoli, where they were held in reasonable comfort in a safe house until their eventual release this morning.
After Libyan demands for a U.S. diplomat to be sent to Tripoli to collect the journalist was rebuffed, the Turkish Embassy was allowed to act as an intermediary.

Even then there was an agonizing last minute hitch when the planned release on Sunday was postponed because of the coalition bombing.
After the four were safely out of Libya, Bill Keller, the executive editor of the Times, said he was ‘overjoyed’ at the news.
‘Because of the volatile situation in
Libya, we’ve kept our enthusiasm and comments in check until they were
out of the country, but now feels like a moment for celebration,’ he
wrote in a note to the newsroom.
‘We’re
particularly indebted to the government of Turkey, which intervened on
our behalf to oversee the release of our journalists and bring them to
Tunisia,’ Mr Keller added.
‘We were also assisted throughout the week by diplomats from the United States and United Kingdom.’
Thirteen journalists are still said to be either missing in Libya or in government custody.
They
include four from the Al Jazeera Arab TV network, two from Agence
France-Presse news agency and a photographer from Getty Images. Six
Libyan journalists are also unaccounted for.
Last
month, South African journalist Lara Logan, Chief Foreign
Correspondent for CBS, was also sexually abused while covering scenes of
celebration in Cairo's Tahrir Square.
Miss Logan was surrounded
and suffered a brutal and sustained sexual assault before being saved by
a group of women and Egyptian soldiers. 
The mother-of-two needed hospital treatment on her return to the US.

There has only been muted opposition to this far-reaching policy among the professionals and advocates in the education sector, most of whom are heavily reliant on funding and support from top-level education officials. The normally government-averse tech-sector is also playing along, and on Mar. 11, Facebook declared that it was “thrilled” to work with White House officials to foster government oversight of teens’ online activities.
The only formal opposition has come from the National School Board Association, which declined to be interviewed by The DC.

It’s no great surprise that federal bureaucrats, Facebook, and the ACLU are on board with this. But…the teachers’ unions are fine with teachers and administrators being put in legal jeopardy for what kids do on Facebook, on their own time? Really?
Even creepier than the policy itself, is who has been charged with overseeing it.

The leading advocate for the expanded rules is Kevin Jennings, who heads the Education Department’s Office of Safe and Drug-Free Schools.

Jennings’ is a name that just keeps popping up in the Obama era. He ran that White House bullying summit last week. As Zombie wrote at the time, Jennings brings quite a history to the field of education — a history that includes child porn in the classroom, failing to report a child predator, and proclaiming to have been inspired by NAMBLA’s Harry Hay.  Quite a history the so-called “safe schools” czar has brought to the table. Now he’s advocating that your kids’ teachers Facebook stalk your kids.
And the teachers’ unions have nothing to say about this? Don’t the teachers; unions have teachers a) who will wind up in court over this, and b) kids in school who may end up running afoul of whatever insane rules the likes of Kevin Jennings comes up with?

The agency’s threats, which are delivered in a so-called “Dear Colleague” letter,” have the support of White House officials, including President Barack Obama, who held a Mar. 10 White House meeting to promote the initiative as a federal “anti-bullying” policy.

The letter says federal officials have reinterpreted the civil-rights laws that require school principals to curb physical bullying, as well as racist and sexist speech, that take place within school boundaries. Under the new interpretation, principals and their schools are legally liable if they fail to curb “harassment” of students, even if it takes place outside the school, on Facebook or in private conversation among a few youths.

“Harassing conduct may take many forms, including verbal acts and name-calling; graphic and written statements, which may include use of cell phones or the Internet… it does not have to include intent to harm, be directed at a specific target, or involve repeated incidents [but] creates a hostile environment … [which can] limit a student’s ability to participate in or benefit from the services, activities, or opportunities offered by a school,” according to the far-reaching letter, which was completed Oct. 26 by Russlynn Ali, who heads the agency’s civil rights office.

School officials will face lawsuits even when they are ignorant about students’ statements, if a court later decides they “reasonably should have known” about their students’ conduct, said the statement.

Following the discovery of “harassment,” officials may have to require mandatory training of students and their families, according to the Ali letter. “The school may need to provide training or other interventions not only for the perpetrators, but also for the larger school community, to ensure that all students, their families, and school staff can recognize harassment if it recurs and know how to respond… [and] provide additional services to the student who was harassed in order to address the effects of the harassment,” said the letter.

Facebook is developing new features that will make it harder for principals to miss episodes of online “harassment,” and so will increase the likelihood of government action against the teenage users of Facebook and other social-media. “We’re adding a unique feature, developed with safety experts, that lets people also report content to someone in their support system (like a parent or teacher) who may be able to address the issue more directly,’ Facebook declared Mar. 11. “It is our hope that features like this will help not only remove the offensive content but also help people get to the root of the problem,” the company statement declared.

Dutch will look into NGO funding of anti-Semitic website

NGO Monitor told the Post that “EI executive director Ali Abunimah is a leader in delegitimization and demonization campaigns against Israel. In his travels and speaking engagements, facilitated by Electronic Intifada’s budget, he calls for a one-state solution to the Israeli-Palestinian conflict and routinely uses false apartheid rhetoric.”

“Abunimah also equates Israel to Nazi Germany, comparing the Israeli press to Der Stürmer, referring to Gaza as a ‘ghetto for surplus non-Jews,’ and claiming that ‘Zionism is not atonement for the Holocaust, but its continuation in spirit.’” NGO Monitor criticized ICCO’s employment of Mieke Zagt, who is “the ICCO official directing the funding to EI,” a “former employee of Amnesty International’s Middle East division, and a vocal proponent of BDS herself.” BDS is the abbreviation for the Boycott, Divestment and Sanctions movement targeting Israel.

NGO Monitor reveals Dutch government funding for Electronic Intifada

IMRA: Electronic Intifada (EI), a website that publishes articles that compare Israelis to Nazis and promotes campaigns for anti-Israel BDS (boycotts, divestment and sanctions), has received funding indirectly from the Dutch  government. The Interchurch Organization for Development Cooperation (ICCO), a Netherland-based NGO has supported EI since at least 2007, including a 3-year funding commitment. ICCO receives 95% of its budget from the Dutch government and the EU.

In 2008, ICCO received €124 million in Dutch government funds, representing 90% of its €139 million budget. An additional €8.5 million (6.1%) came from the European Commission (Annual Report, p. 135). When NGO Monitor contacted ICCO regarding funding for EI, our researcher was directed to the coordinator of government funds, Mieke Zagt. Ms. Zagt did not return NGO Monitor’s phone calls or emails.

As documented by NGO Monitor, EI plays a central role in the Durban strategy of political warfare against Israel, with frequent accusations of “apartheid,” “ethnic cleansing,” and “slow genocide.” Articles on the EI site justify violence against civilians, call Gaza a “concentration camp,” and label Palestinian participation in peace talks as “collaboration.” EI has an extensive section supporting the Boycott, Divestment and Sanctions (BDS) movement against Israel. EI co-founder Ali Abunimah, as well as other contributors, also employ antisemitic and anti-Israel themes in their writings and Twitter statements.

Despite the evidence to the contrary, ICCO praised EI as an “internationally recognized daily news source” that “contributes to a balanced opinion.”

In an article (Jerusalem Post, November 26, 2010), journalist Benjamin Weinthal quoted Netherlands Foreign Minister Uri Rosenthal: “I will look into the matter personally. If it appears that…ICCO does fund [EI], it will have a serious problem with me.”

In sharp contrast, Chairman of ICCO’s Executive Board Marinus Verweij called EI “an important source of information” and said “in no way is the EI anti-Israel or anti-Semitic.” The Post also reported that ICCO informed the Dutch government that EI “was funded with Dutch subsid[ies] until 2010. From 2010 on it has allocated only non-subsidy funding.” The evidence for this claim has not been provided.

Egyptian state security headquarters stormed

A personal story was that I was promoting my father's business teaching Shakespeare and I went to talk to KingLear on AOL... and KING LEAR (as it turned out was not KING LEAR), but rather had the behavior of a sex offender (and this KING LEAR was EGYPTIAN). just one out of a gazillion stories.

I don't think it's gotten much play outside of Egypt except on Twitter, but hundreds of Egyptians invaded their state security headquarters on Saturday. Despite the fact that reports indicated that the state security was shredding documents for 'days,' there were still some juicy finds like the tape pictured above, which is said to be a 'sex tape' involving a Kuwaiti princess and an Egyptian businessman.

Egyptian protesters have stormed the headquarters of Egypt's state security force in Alexandria, with several people suffering injuries in scuffles with riot police.
Around 1,000 people encircled the State Security Agency building late on Friday, demanding that the officers inside come out or they would storm the building.
Protesters then entered into the building and scuffled with riot police before military forces intervened and took control of the building.
Demonstrators said officers inside had been shredding and burning documents that may have proven past abuses.

The activists, who called the protests were demanding the abolition of the state security apparatus and an end to emergency laws.
Egypt's internal security services and police forces, which were given a free hand to suppress dissent under the rule of ousted president Hosni Mubarak, remain to be a powerful symbol of the former regime.
Activists say security agencies arrested and tortured thousands of activists and killed many during the 30 years Mubarak stayed in power.
Ismael Alexanderani, a journalist and protester at the scene in Alexandria, told Al Jazeera that a minority of protesters were seeking "revenge" against the security forces, as several political activists who were present at the demonstration had been arrested or tortured inside the building earlier.

One of the things that the demonstrators claim to have found is belly-dancing suits. But many of the computers that were found had their hard drives ripped out.
The security services even kept files on the Mubarak's themselves. But I doubt much will come out about anyone else.
