Hot Air (Britain’s spy agency GCHQ has secretly gained access to the network of cables which carry the world’s phone calls and internet traffic and has started to process vast streams of sensitive personal information which it is sharing with its American partner, the National Security Agency (NSA).
The sheer scale of the agency’s ambition is reflected in the titles of its two principal components: Mastering the Internet and Global Telecoms Exploitation, aimed at scooping up as much online and telephone traffic as possible. This is all being carried out without any form of public acknowledgement or debate.
One key innovation has been GCHQ’s ability to tap into and store huge volumes of data drawn from fibre-optic cables for up to 30 days so that it can be sifted and analysed. That operation, codenamed Tempora, has been running for some 18 months.
GCHQ and the NSA are consequently able to access and process vast quantities of communications between entirely innocent people, as well as targeted suspects.
This includes recordings of phone calls, the content of email messages, entries on Facebook and the history of any internet user’s access to websites – all of which is deemed legal, even though the warrant system was supposed to limit interception to a specified range of targets.)

IF you've ever viewed Twitter as a gauge of public opinion, a weathervane marking the mood of the masses, you are very much mistaken.
That is the rather surprising finding of a new US study, which suggests the microblog zeitgeist differs markedly from mainstream public opinion.
"Twitter users are not representative of the public," Washington DC think tank, Pew Research Center, concluded.
Experts in Australia, where Twitter comment is regularly used in media reaction to major new stories or a method of interaction for television programs like the ABC's Q&A, agreed with the US findings.
"While Twitter can give you a good idea of the extremes of how people feel about certain topics, when it comes to measuring opinion of the general public about major issues, it's pretty useless," Laura Demasi, of marketing firm IPSOS Australia, told AAP.
Pew Research's study examined eight major US news events, including November's presidential election, and compared views expressed on Twitter with national polling.
The two didn't match.
"At times the Twitter conversation is more liberal than the survey responses, while at other times it is more conservative," the study said.
The study highlighted a decision made in California's Federal Court which ruled that laws barring same-sex marriage were unconstitutional.
Almost half of the Twitter conversations about the verdict were positive, eight per cent were negative and 46 per cent were neutral.
But wider public opinion on the decision was more mixed - with 33 per cent saying it was a positive ruling, 44 per cent negative and 15 per cent neutral.
The reason, Pew Research Center says, is that only a "narrow sliver" of the population use Twitter.
A recent study by French social media analysts Semiocast showed there were 140 million Twitter accounts in the US - more than one third of the population.
But users tend to be younger and lean more toward the political left than right, the study said.
Ms Demasi added: "Twitter penetration in Australia is not that big so while at times it seems like the whole country is talking about something, it's really just 50 people and a few hundred or thousand who are listening in."
Dr John Lenarcic, from Melbourne's RMIT University, suggested Facebook may offer a more accurate view of public sentiment.

(Swartz suicide won't change computer crime policy, says prosecutor • The Register) The aggressive prosecution of computer crimes won't be changed in light of the suicide of internet activist Aaron Swartz, a spokeswoman for Boston US Attorney Carmen Ortiz has said.
"Absolutely not," Ortiz told the Boston Herald. "We thought the case was reasonably handled and we would not have done things differently. We're going to continue doing the work of the office and of following our mission."
Swartz is the second suicide linked to Boston computer crime investigations. Jonathan James, who gained notoriety in January 2000 as a teenager who cracked Department of Defense and NASA systems, shot himself in the head in 2008 after being named as a suspect in Ortiz's biggest computer crime case, the TJX hacking scam. Over 94 million accounts at retailer TJX were compromised in an attack that was at that time the most extensive yet seen, and James was named as a conspirator. While he denied involvement in the crime, James said he had no confidence in the legal system and shot himself before the case came to court

(Swartz Suicide Propels Facebook Search for Danger Signs - Bloomberg) Swartz’s death follows a pattern of high-profile suicides within the industry. In 2008, Jonathan James, a hacker who was the first juvenile incarcerated for cybercrime in the U.S., died at age 24. In 2009, Dan Haubert, a co-founder of TicketStumbler, died when he was 25. Gene Kan, the founder of InfraSearch, died in 2002, at age 26. In 2011, Ilya Zhitomirskiy, a co-founder of the social media site Diaspora, died by suicide at age 22.
Facebook Inc. (FB) is helping to open a window into the minds of those who die by suicide.
The social media site is providing researchers at the suicide prevention group SAVE.org a glimpse of how those who take their own lives behave in the days leading up to their deaths, as outlined in their Facebook postings. Dan Reidenberg, executive director of Save and a national leader in the counseling field, expects the information will one day help friends, family and social media sites better identify warning signs in the words and actions that lead up to suicide. It will be a year before they have the data gathered, he said.
Facebook isn’t alone in its efforts. Twitter Inc. and Google Inc. (GOOG) also have put systems in place over the last few years that direct at-risk users to counseling help, or allow others to report concerns to the company.
Twitter itself isn’t conducting research on suicide prevention, said spokesman Jim Prosser in an e-mail. However, an outside researcher or group could conduct a study using Twitter data, he said.
Google’s search engine, meanwhile, has been designed to bring up the phone number for the National Suicide Prevention Lifeline for any searches on “suicide” or related terms, said Jay Nancarrow, a spokesman for the Mountain View, California- based company.

Men? Well, apparently gay bars and tech-startups had the highest proportion of men, whilst travel and airports also featured highly. Yeah... maybe the gay marriage issue wasn't getting the momentum you thought it was... you just don't talk to people in reality... that's all.

(finance.yahoo.com) DUBAI (Reuters) - Saudi billionaire Prince Alwaleed bin Talal, an investor in some of the world's top companies, has bought a stake in Twitter for $300 million, gaining another foothold in the global media industry.
Alwaleed, a nephew of Saudi Arabia's king and estimated by Forbes magazine to be the 26th richest person in the world with a $19.6 billion fortune, already owns a 7 percent stake in News Corp and plans to start a cable news channel.
The purchase is remarkable because Twitter was a key means of communication for protesters in the Arab Spring revolts this year, violence that threatened Saudi Arabia until the kingdom unveiled a populist $130 billion social spending package.
Twitter, which allows people to send 140-character messages, or Tweets, to groups of followers, is one of the internet's most popular social networking services, along with Facebook and Zynga.
The Twitter stake, bought jointly by Alwaleed and his Kingdom Holding Co investment firm, resulted from "months of negotiations," Kingdom said.
Bernhard Warner, co-founder of analysis and advisory firm Social Media Influence, said: "The Arab world, of course, knows full well the value of Twitter. In the past year, it has been a force in politics, in regime change, so there is not a single person in that region in a position of influence who is not following the increasing power of Twitter.
"(Alwaleed) must see Twitter as something that is going to be a really powerful broadcast channel," he said, adding the Saudi had got into the internet boom belatedly, with mixed results, and appeared to be "kind of late" to the game again.
Investors in Saudi Arabia were more bullish, sending shares in Kingdom up 7 percent to 8.40 riyals.
"One of the few sectors to record significant revenue gains in the last three years has been technology, which is why Kingdom would see Twitter as a good addition to its diversified portfolio," said Hesham Tuffaha, head of asset management at Bakheet Investment Group in Riyadh.
Saudis are increasingly turning to satellite television, online news providers and social networking to stay abreast of world events. The world's No. 1 oil exporter announced a series of stricter regulations for journalists earlier this year.
Alwaleed, who has a sizeable stake in Citigroup, has spoken in favour of broader political participation, fair elections and effective job creation across the Arab world.
IPO HOPES
Investors are eagerly anticipating an initial public offering from Twitter, which said in September it was in no hurry to go public. It raised $400 million in venture capital financing this summer.
It now counts more than 100 million active users who log onto the service at least once a month. Facebook, the world's largest social network has more than 750 million active users.
Internet search giant Google recently launched a social networking service dubbed Google+ which some observers say could lure users away from Twitter.
Shares in online games developer Zynga ended at a 5 percent discount to their issue price on their trading debut on Friday, and analysts said any valuation for Twitter could be misleading.
"You could put any number of zeroes behind a valuation of a private company. Before it goes public, it is almost meaningless," said Warner.
"This is a very small group of investors which has put money into this thing. That will be diluted and diluted and diluted again until it goes public. And that is when we will see what the value is. These are kind of magic numbers at the moment."
Kingdom owns a near-30 percent stake in Saudi Research and Marketing Group, which runs a range of media titles.
"Our investment in Twitter reaffirms our ability in identifying suitable opportunities to invest in promising, high-growth businesses with a global impact," Alwaleed said.
Alwaleed subscribed $500 million to last year's General Motors IPO. In August, he unveiled plans to build the world's tallest tower in Jeddah.

NY Judge: No Facebook “Fishing Expedition,” Denies Social Media Discovery Requests

Last week a New York trial judge denied a defense discovery request for a personal injury plaintiff’s current and historical Facebook, MySpace, and Twitter account information.
New York Justice George J. Silver of State Supreme Court in Manhattan reasoned that simply making conclusory allegations that a party’s “Facebook account is material and necessary to their [client's] defense” is insufficient to justify disclosure of a litigant’s private Facebook records. (MORE)
That is good to know. Let's hope this type of finding is not overruled in states that are more liberal. Prosecution could move to a state where a person's internet rights don't exist in the same way.

Your Facebook Comments, Coming Soon to a Google Search Near You

Google’s all-seeing search robots still can’t find comments on private pages within Facebook, but now any time you use a Facebook comment form on a other sites, or a public page within Facebook, those comments will be indexed by Google. The new indexing plan isn’t just about Facebook comments, but applies to nearly any content that’s previously been accessible only through an HTTP POST request. Google’s goal is to include anything “hiding” behind a form — comment systems like Disqus or Facebook and other JavaScript-based sites and forms. Typically when Google announces it’s going to expand its search index in some way everyone is happy — sites get more searchable content into Google and users can find more of what they’re looking for — but that’s not the case with the latest changes to Google’s indexing policy. Developers are upset because Google is no longer the passive crawler it once was and users will likely become upset once they realize that comments about drunken parties, embarrassing moments or what they thought were private details are going to start showing up next to their names in Google’s search results. For now most of the ire seems limited to concerned web developers worried that Google’s new indexing plan ignores the HTML specification and breaks the web’s underlying architecture. To understand what Google is planning to do and why it breaks one of the fundamental gentleman’s agreements of the web, you first have to understand how various web requests work.There are two primary requests you can initiate on the web — GET and POST. In a nutshell, GET requests are intended for reading data, POST for changing or adding data. That’s why search engine robots like Google’s have always stuck to GET crawling. There’s no danger of the Googlebot altering a site’s data with GET, it just reads the page, without ever touching the actual data. Now that Google is crawling POST pages the Googlebot is no longer a passive observer, it’s actually interacting with — and potentially altering — the websites it crawls. While it’s unlikely that the new Googlebot will alter a site’s data — as the Google Webmaster Blog writes, “Googlebot may now perform POST requests when we believe it’s safe and appropriate” — it’s certainly possible now and that’s what worries some developers. As any webmaster knows, mistakes happen, especially when robots are involved, and no one wants to wake up one day to discover that the Googlebot has wreaked havoc across their site. If you’d like to stop the Googlebot from crawling your site’s forms, Google suggests using the robots.txt file to disallow the Googlebot on any POST URLs your site might have. So long as you’re surfacing your content in other ways — and you should be, provided you want it indexed — there shouldn’t be any harm in blocking the Googlebot from POST requests. Israel’s Supporters Must Learn from the Enemy

(Bill Levinson) We removed our post that compared Henry Ford’s proven job creation methods with Barack Obama’s proven job destruction methods because a couple of readers expressed outrage against Ford personally because of his involvement in anti-Semitic activities. We do not agree with these readers (as shown below) but we don’t want to put Ted in the position of circulating a piece to which people might take exception. This shows, however, that Euro-Americans in general and Jews in particular have failed to understand a simple point: a person we might find offensive or unsavory, or even an outright enemy, is often the best teacher. Our collective failure to learn this lesson puts Israel in particular and Civilization as a whole at considerable and even mortal risk. We will begin with a couple of extremely simple examples of this principle. The United Kingdom is famous for the 95th Rifles, a regiment immortalized by Bernard Cornwell’s Sharpe series.The UK is also famous for its rocket artillery, as immortalized by “the rockets’ red glare” in our National Anthem. Neither rifle-armed skirmishers nor artillery rockets were however British inventions; both were examples of learning from the enemy.The War of Independence taught the British that a man in a bright red coat with a musket that could not hit reliably beyond 70 to 100 paces was an easy mark for a rifleman in dull-colored clothing who could melt into a forest after firing. They accordingly created an Experimental Corps of Riflemen (later the 95th Rifles) who wore dark green uniforms to blend in with foliage, much as their American opponents had blended in with their surroundings. The Congreve Rocket was meanwhile the result of the British being on the receiving end of Tipu Sultan’s rocket artillery during the Anglo-Mysore Wars.
We obviously do not agree with what Henry Ford published about Jews, or for that matter his support for Prohibition or his “sociology department” that intruded on his employees’ private lives. We did an Internet search on suspicion and found Henry Ford on a list of historical figures (along with Abraham Lincoln, Thomas Edison, and George Washington) who were suspected of having Asperger’s Syndrome.
People with Asperger’s Syndrome are often described, as having social skills deficits, reluctance to listen, difficulty understanding social give and take, and other core characteristics, is typically quite misunderstood and/or misdiagnosed in our country today.
Other characteristics include a lack of empathy and a fascination with systems, i.e. “how things work.” The latter certainly describes Ford, noting his boyhood fascination with taking watches apart and even being able to put them back together. His production line was described as a giant clock, and it relied on workers as “components” who performed repetitive tasks to make the clock work. The system’s success paid the “components” high wages but it is quite likely that Ford viewed people as something like elements of a machine–hence his infamous Sociology Department–with roughly identical desires and motivations. If Ford did have Asperger’s, he could have understood intellectually that he needed to pay fair wages to gain his workers’ commitment but it is doubtful that he could really empathize with them on an emotional level. If true, this theory explains quite a bit. Aldous Huxley’s Brave New World (in which Ford is God, My Life and Work is the Bible, and people are manufactured to fit society’s needs) constitutes Fordism taken to the extreme.
In any event, The International Jew was not Henry Ford’s creation. It a translation of the Protocols of the Elders of Zion that was given to Ford by the Tsarist Russian propagandist Boris Brasol. To put this in contemporary terms, Ford saw the equivalent of a sensationalistic Web site or E-mail, copied it to everybody on his mailing list, and pressed the “Send” key. His “Send” key unfortunately consisted of the Dearborn Independent, so what he circulated caused substantial harm to Jews and, in the end, Ford’s own reputation.
What then are the lessons to be learned from this experience? How many of us have, at one time or another, forwarded an E-mail or Web posting without investigating thoroughly? We have received them from highly intelligent and well educated friends only to find, after investigating, that the material was untrue. The National Jewish Democratic Council relied on somebody else’s blog posting or equivalent to publish a vicious falsehood about the Christian computer game “Left Behind: Eternal Forces.” None of this excuses Ford for his own failure to investigate Brasol’s material thoroughly but we must make sure we do not repeat the same mistakes.
Let’s assume for the sake of argument the absolute worst about Henry Ford. This does not change the fact that his methods created the American middle class along with the 40 hour work week, and made the United States the wealthiest and most powerful nation on earth. Our thoughts must now move to application of this knowledge to our country’s current problem: an incompetent buffoon in the White House who has proven repeatedly that he knows nothing about how to create jobs or prosperity. (The same individual wishes to reward Palestinian terrorism with territorial concessions at Israel’s expense.) We should welcome assistance from any source that will help remove Obama from office next year and, even more importantly, create high wage jobs for the millions of American workers who need them!
Now let’s move on to a genuine Nazi who has plenty to teach us. Most people cannot get past their revulsion at Hitler’s statement, “If you win, you need not have to explain. If you lose, you should not be around to explain,” to internalize the truth of this observation. Hitler lost so he had to follow his own advice on April 30, 1945. His equally murderous and genocidal counterpart Josef Stalin was on the winning side so he never had to explain. Neither did Mao Tse Tung or Pol Pot, for that matter. This applies directly to Israel versus its militant Islamic neighbors: “If you win, even if you have to kill several million Arab aggressors and inflict some collateral damage while you do it, you won’t have to explain. If you lose by playing nice and worrying about world opinion, you won’t be around to explain.”
We observe further than ancient Jewish history was not very “nice,” with the result that today’s Jews need not explain while the Canaanites and so on are not around to explain. Roman history was not very “nice” either but the sole consequence of Rome’s genocide of the Carthaginian people is that Southern Europe and even England speaks words with Latin instead of Phoenician roots. Modern Hungary and Mongolia have statues, currency, and/or postage with images of Attila the Hun and Genghis Khan, neither of whom were nice people but who did outstanding jobs for the Huns and the Mongols respectively. Ann Barnhardt elaborates further on the problems with being “nice.” (Christian-oriented material can be ignored without loss of continuity.)
This is not to say that Israel or any decent country should initiate aggression today even though history shows it can often get away with it. It does say that, if an aggressor attacks you, you must take him down in such a manner that he will never lift a hand to you again. Only in movies must the hero (or often a terrified female victim who turns the tables momentarily) let the downed serial killer or monster get up again, and that’s only because the movie can’t end at the 45 minute mark. If you put your attacker down for good, you don’t have to explain. If you let him get up again (in the absence of law enforcement personnel who can take him into custody), it is quite likely that you won’t be around to explain. Israel should have put its attackers down for good in 1967.
Most people and especially Jews are meanwhile reluctant to read Mein Kampf because of its content and authorship. This is EXACTLY why the Arabs, who love the book not merely for its anti-Semitic aspects but for its very practical content, are currently demonizing Jews in general and Israel in particular the way the Nazis demonized Jews during the 1930s.
Mein Kampf however goes beyond a discussion of how to use propaganda effectively; it shows explicitly that Hitler followed the advice to learn from the enemy, in this case the Triple Entente. The Entente and its American sympathizers demonized Germans the same way the Nazis later demonized Jews. The following could in fact be described as a blood libel of Germans, noting that it was proven that the Lusitania carried munitions and was therefore a legitimate military target.

Main Kampf states explicitly that Germany failed to recognize the effectiveness of this kind of propaganda, and failed to reciprocate in kind: with visual images designed to appeal to the lowest common denominator, the man in the street and the man in the beer hall. If the Jews in Israel could bring themselves to read Mein Kampf, they would realize that Israel is repeating Imperial Germany’s mistakes to the letter while the enemies who want to destroy it are working straight from the Entente’s (and later the Nazis’) playbook.
Arab propaganda; could have been drawn by genuine Nazis
Our recommendation is and has always been retaliation in kind and with an enormity of compound interest, to dehumanize Israel’s enemies and militant “Islam” in general every bit as thoroughly as the Entente dehumanized the Central Powers. We should not hesitate to adapt propaganda images from the Second World War that were used to demonize Nazis and Japanese, along with similar material from the First World War and Spanish American War. As but one example:

Ethics and honor require only that the propaganda be truthful (and the militant Muslims have provided our side with an unlimited supply of truth), and that hatred and contempt be directed selectively against a specific behavioral choice (militant Islam) and never against an entire religious identity, race, or ethnicity.
George Santayana wrote that those who cannot remember the past are condemned to repeat it. Those who cannot or will not learn from the enemy, even an enemy as loathsome as Hitler, are likely to become history.

Agreed, but I disagree that Ford merely pressed the send button on facebook. Ford trolled the equivalent of internet forums for decades. He was more then just some guy who distributed Antisemitism. He was completely obsessed with it's philosophy. Asperger syndrome is more then just Rain Man. It is more then just being systematic. Asperger syndrome is a tendency to be obsessed with a system and in this case the system was hate. We still can learn a lot from the most despicable people. On my friendfeed account I follow many twitter accounts that have complete contempt for my being. Should they know that I follow them in this manner they would probably call me a stalker. In fact one person I followed who was a former teacher even put me on the news as such. The point being is these people I follow not because they are complete idiots...many of them are geniuses... and many of them probably hate me. One example of a complete genius who I have been following for years goes by the name of SeanMcBride (on both twitter and friendfeed). He is a complete tech genius, and a debater that leaves me in awe. His contempt for Israel (though he does not hate Jews), leaves many writing him off as a common thug. He is no such thing. His genius for systems has led him to believe in the fear of Zionism and Neo Cons. My guess is he is similar personality to Henry Ford and I can't tell you how informative his feed is. Both in Tech and Israel News (though in the latter it is our enemies spin). The point is that I am wise enough to follow those I don't like. The world is full of grey area. The beauty of open feeds on the internet is that we can peer into the minds of those who are our opposition because those who do not like us have huge egos and want to share their information without realizing how easy it is to subvert that information. I suppose I am guilty of doing the same and I have no doubt that my opinions will be used against me (actually they were used against me in court and my first amendment rights were taken away by the state of Washington). Point being however is that we must not write people off just because they are Nazis or Anti-Zionists. We must enjoy the work of Wagner or the malarkey of the children's book writer Roald Dahl. To reject those brilliant minds that reject us is futile. Sometimes there might even be brilliant Zionist writers who have flaws in other ways. I'd like to tell you who those people are, but it would hurt my own cause. A few people do come to mind however... I won't mention the name. I can tell you that I still have a deep respect for their mind... and I leave them the hell alone because on a social level they are nuts. The worst is when two very flawed Israel supporting geniuses start attacking each other... and then even go so far as to get people out on the internet to take one side or the other. Life is complex. I have no doubt that there will come a day when I might depend on the guy above I mentioned SeanMcBride (who is my enemy) to defend me from people who are supposed to be on my side. I am known to be an opponent of feminism... (though I am a descendant of Emma Lazarus), but when I was in jail I depended on my feminist mother to get me out (The female and probably feminist identifying Jewish judge just would not listen to me). Never write out your opponent... and never assume because a person supports Israel that they are to be trusted. BTW, the teacher I described above... she wasn't stupid either. Just crazy.

After this post was made I received a warning and a penalty from facebook for friending "PEOPLE who I don't KNOW". Like most activists I network with like minded people and not PEOPLE I KNOW. Facebook doesn't like it's feathers ruffled. They are trying to remind me that they can act in a PUNITIVE manner. Typical Seattle politics. If you are wondering why I am using the deplorable hashtag, it is to remind the social networks of the hypocritical culture that they enable. I know for a fact that the people and law in Seattle will look the other way at Anti-Semitism, but will be upset by misogyny. My hope is that the worst lemmings of feminist culture will be shocked and click the link and be faced with their own double standard.

In fact these comments were made during the period where facebook deleted the profile of David Appletree of the JIDF. Notice they didn't do the same thing for Yerkzilla The DinoJew. But supposedly the JIDF profile was deleted because facebook claimed Appletree wasn't a real name. So what is Bronagh Cleeverhook Gallagher up to these days? I'm not a fan of Wiener the Macho Spaz, but I believe him here...
Over the last few days New York Congressman Anthony Wiener, a Democrat, claimed that his Twitter account had been hacked when it was revealed that "someone" sent a sexually graphic picture to a young woman in Washington State from his account.
The photo, a picture of a briefs-clad man sporting an erection, was sent to a young college student named Gennette Nicole Cordova who is a student at Whatcom Community College, Bellingham, Washington. This young woman once Tweeted that Wiener was her "boyfriend." No one is sure what sort of relationship Wiener has with Cordova if any. But there seems to be some links.
Another reason why this is very suspicious. Miss Cordova is purported to be just some random person that the Wiener Twitter "hacker" targeted. What makes this seem less and less likely is that Miss Cordova has in the last two days gone to great lengths to try and erase herself from the Internet. She has systematically closed accounts and even removed her name from stories she wrote for her school newspaper. If she was just an innocent, random person in this story, why has she gone to such pains to try and erase herself like that? Seems more like guilt driving her actions, don't you think?

WHAT? Do you have any idea how many times my twitter account has been hacked and twitter did nothing about it? Yes... I know he is a Democrat... and I don't even really like him... but this sounds like an online sex lynch mob against a Jew. the libel doesn't stop... even against Jews who are liberal.
Why would a hacker hack Wiener's Twitter account to send only one photo to some girl in Washington State (who claimed to be his girlfriend) and then just leave without doing other things?
because it destroyed his reputation and the hacker did not want to stay around to get caught... duh!
Its far more likely that Wiener sent the photo himself. This elaborate "I was hacked" story does not ring true.

The "Jews" page shares a lot of our work, and a lot of other great, pro-Israel and Jewish information with their fans. Facebook appears to be in the process of censoring that page. It's either that, or an unfortunate glitch, but considering:
  • Facebook's history of censoring pro-Israel, Jewish material (see here, here and here) 
  • Facebook's threats of censoring other content produced by people they arbitrarily "just don't like" (see here) 
  • The fact that they allow thousands of anti-Israel, Holocaust denial, and other antisemitic and Islamic terrorist pages (see here, here, here, here and many other pages on our site)
  • The fact that they submitted to Islam by censoring the "Everybody Draw Mohammed Day" groups
...we don't think this is a coincidence.
We feel this might also be politically motivated, especially considering one of Randi Zuckerberg's (sister of the founder of Facebook) recent Tweets:

Some sober analysis of the "Arab Spring"

Syrian soldiers have been shot by security forces after refusing to fire on protesters, witnesses said, as a crackdown on anti-government demonstrations intensified:...The Arab Spring can never bloom if the people can not be heard because of Saudi fears.

The Arab media has largely been silent about what's been going on in Syria. And the Western media have followed their lead. Lee Smith explains why.
What’s peculiar is that given the size of the uprising—people are in the streets of every major Syrian city except Aleppo—and the bravery of the demonstrators, there’s been little attention paid to it. After all, these are not Egyptian security forces under the command of a U.S. ally like former president Hosni Mubarak. Any Syrian who steps out into the street understands that if security forces have a clear shot, they’ll take it, and no one is going to stop them, certainly not the regime, and not fear of repercussions from the international press either. The same Western and Arab media that covered the Egyptian uprising as it unfolded is all but absent from Syria.


The New York Times’s reporting is coming out of Cairo and New York; the Washington Post’s coverage is based in Beirut; Reuters has people in Damascus, but the regime keeps detaining them and throwing them out. That is to say, the Assad regime has done an excellent job of keeping the curtains closed on events, so that the main source of news coming directly out of Syria is almost exclusively from the Internet, YouTube, Facebook, and Twitter. The social media galvanized Egyptian and Tunisian protestors, but for the Syrian opposition it is the main source of media they have to show the world what’s happening.
As Washington, D.C.-based Arab journalist Hussain Abdul Hussain notes:
Arab satellite channels dedicated more air time to Syria than in the previous weekdays. The first 30-minutes of Al-Jazeera's news coverage were dedicated to clashes in Syria. However, Al-Jazeera, which has been exceptionally silent on Syria, perhaps because of the good alliance between Assad and Al-Jazeera's owner the Sheikh of Qatar Hamad Bin Khalifa Al Thani, cherry-picked its coverage of Syrian rallies.
But the lack of coverage cannot be entirely blamed on al-Jazeera.
Young also faults Al Arabiya, the majority-Saudi-owned network, founded in 2003 for no other purpose than to deter its Qatari rival, Al Jazeera, which came to prominence through its attacks on Riyadh and other Arab rivals, including Cairo.
To toss Al-Jazeera and Al-Arabiya into the same basket is entirely justified here, because both Saudi Arabia and Qatar share a desire to avert a breakdown in Syria, fearing that chaos might ensue. Their views are echoed by a majority of Gulf states, whose leaders have called Assad lately to express their backing.
It’s true that the Saudis, who have been at loggerheads with Syria ever since they suspected Syrian involvement in the murder of former Lebanese prime minister Rafiq Hariri, don’t want to see Assad fall. They fear that the wave of Arab uprisings is likely to reach them next, and this is a good place to block a domino. However, other Saudi-owned media, like the pan-Arab London-based newspaper Asharq al-Awsat, has been unsparing in its criticism of Damascus.
Perhaps that’s because the Saudis recognize that in a region with soaring illiteracy rates, video is a much more powerful medium than the printed press. Of course, it’s also possible to overstate the influence of Al Jazeera, especially compared to one of the region’s oldest and most powerful media, the sermon at Friday noon prayers. Last week in Beirut I heard rumors that the Saudis had instructed Sunni sheikhs and imams throughout Syria to calm things down and keep people out of the street. Apparently, the Saudis’ wishes were scattered by the winds of the Syrian uprising.
And Western media is just following the Arab lead rather than doing their job. What could go wrong?

A possible landmark copyright case is now before the 2d Circuit, Viacom et al. v. YouTube. On behalf of 44 co-signatory law professors, Annemarie Bridy and I wrote an amicus brief urging the court to affirm the lower court’s decision that YouTube is immune from copyright claims unless it has item-specific and location-specific information about infringing postings. The brief — which I think turned out quite well, and is, at the very least, a good example of decent legal prose — is available here. I’ve reprinted below some of my comments from earlier postings about the case. I could be falling prey to a common syndrome: when you work as an advocate for one side in a case for a while, you begin to believe that you have truth and justice firmly on your side, that the opposing position is outrageous and contrary to all common sense and moral principle . . . . But I really do think this one matters, for the future of the Net.
It was a bit more of an adventure submitting this brief than it should have been — the 2d Circuit does not treat its “amici” in a very friendly fashion. Not only must you be admitted to the 2d Circuit bar to submit an amicus brief — no temporary admissions pro haec vice are permitted — but you also have to be sure to be hooked up to the latest version of the court’s electronic filing system; not huge problem, i suppose if you’re a lawyer or law firm practicing frequently in front of the 2d Circuit, but not something that a law professor, even if admitted to the court’s bar, is likely to be current with. And even if the parties themselves require electronic filing, the court does not — so in addition to getting all the aforementioned ducks in a row, you have to comply with the court’s rather arcane printing rules and deliver 6 hard copies to them. Seems all a bit overly formalized, and a means to discourage, rather than encourage, participation — I mean, they don’t have to even read the briefs that are submitted, so why make it so hard for people to submit them?
And one little humorous side note. As noted here, YouTube has changed its “repeat infringer” policy. The Copyright Act requires, as a pre-condition to asserting the immunity from infringement claims provided in section 512, that a service provider
“has adopted and reasonably implemented, and informs subscribers and account holders of the service provider’s system or network of, a policy that provides for the termination in appropriate circumstances of subscribers and account holders of the service provider’s system or network who are repeat infringers; and
YouTube has had such a policy for a while — more or less a “3 strikes and you’re out” kind of thing. [Indeed, one of the truly outrageous things I learned while working on this brief is that Viacom itself was actually thrown off of YouTube as a “repeat infringer” because its marketing department had posted thousands of files for promotional purposes, and its legal department issued hundreds of “takedown notices” with respect to many of them]. But now they’ll let you come back onto the system if you go to “copyright school” — watch a video and take a copyright exam [The video is pretty good — good enough that I couldn’t tell whether it was YouTube’s copyright school or a parody of same . . .]

YouTube successfully defended itself against infringement claims brought by a host of content providers by asserting the “safe harbor” provisions of sec. 512(c) of the Copyright Act, and the case concerns the interpretation of that provision. The section 512 safe harbors have been of prodigious importance — by giving providers of online applications and services a defense to infringement claims arising out of their users’ activities (e.g., user postings of infringing files on YouTube), it has enabled the (astonishing) growth of “user-generated content” or “Web 2.0″ sites over the past decade — YouTube, Facebook, Craigslist, Tumblr, Twitter, Myspace, Blogger, and on and on and on. At the absurdly high volume at which these sites operate — 250,000 words a minute posted on Blogger, 40 hours of video a minute on YouTube, etc. — the liability risk without a safe harbor of some kind is truly astronomical, running into the billions of dollars a day. So you don’t get a YouTube, or a Facebook, or a Blogger, etc. without something like sec. 512; it’s no accident, as I’ve pointed out before, that all of the largest Web 2.0 sites on the global net are based here in the US. And, among other things, if you don’t have a YouTube, or a Facebook, or a Twitter, Hosni Mubarak is still the President of Egypt.
So there’s a lot at stake in how the 2d Circuit — widely regarded, along with the 9th Circuit, as the source of the most important copyright doctrine — interprets the statute. Precedent up to now (mostly in the 9th Circuit) has (correctly) given service providers very broad protection under the statutory immunity; to make a very long story short, the service providers (like YouTube) have no duty to find infringing material that may be present on their site, or to do anything about infringing material on their site, unless and until the existence of the infringement(s) is brought to their attention by the copyright holder. Once they receive such a notification from the copyright holder (through a detailed set of procedures laid out in the statute), they have to act — removing or disabling access to the offending material (and informing the user that they’ve done so). But without receiving the notice of infringement, they’re under no duty to act, and they’re within the safe harbor if the copyright holder subsequently asserts a claim against them.
The content providers don’t like it, needless to say. They’d like YouTube to, say, take down everything uploaded to the site that is labelled “The Daily Show,” for instance, or “Lionel Messi’s Fabulous Goal vs Arsenal,” on the grounds that they should know of the infringing nature of the postings, without having to be specifically informed of that by the copyright holder. If you want to know why that’s both wrong (as a matter of statutory construction) and absurd (as a matter of public policy), read the brief. [It’s pretty short — 18 pages or so of text — and the prose, of course, is crystalline).
If the 2d Circuit endorses the 9th Circuit position — and I fervently hope that it does — that battle, at least, is probably over; there’s not much copyright doctrine out there where the 2d and 9th Circuits are in agreement but some other circuit (or the Supreme Court, for that matter) takes an opposing view.

The brain-dead are up in arms again – and we’re not talking about Qur’an burning pastor Terry Jones:
The kind of simple-minded, ‘me-too’ mentality that feels the need to post on Twitter’s ‘trending topics’ meme-of-the-moment timelines has gleefully rounded on Terry Jones, the US Pastor, who leads the fundamentalist Dove World Outreach Center in Florida – who finally delivered on his promise to publicly burn a Qur’an in protest at the undeniable fact that:
“…….parts of the Koran, if taken literally, do lead to violence and terrorist activities, do promote racism or prejudice against minorities, against Christians, against women,” he said shortly after the Koran burning.
Using Jones’ protest as their cue – and incensed by the usual whipping-up of violent fervour by Islamic clerics, Muslims in Afghanistan went on the rampage in Mazar-e Sharif, Afghanistan. A total of fourteen people were killed, including some of the protesters themselves, three UN workers and four Nepalese guards.
